    Selling a deceased estate in Queensland usually follows the same steps: grant of probate, appointment of executor, appraisal, preparation, sale, and distribution of proceeds.     Do I need probate to sell a deceased estate in Queensland?

    Almost always yes. The Supreme Court of Queensland issues a grant of probate that gives the executor the legal authority to deal with the estate, including selling property. Probate typically takes 6 to 12 weeks from application.

    Can I put the property on the market before probate?

    You can prepare, appraise and even market a property while probate is pending, but you cannot settle a sale until probate is granted. Buyers should be aware settlement is subject to grant of probate.

    Who signs the contract?

    The executor or executors named in the will sign as vendor, once probate is granted. If there is no will, an administrator appointed under Letters of Administration signs.
